What has been done to remedy the situation described above? Have subsequent witnesses been afforded additional protections? What protections are in place for these witnesses in general? What will be done to protect them after the trial? Is relocation necessary, or even an option?

Dear Megan,

Thanks for your comment. Our next analysis will try to address the question you raise and will focus on witness protection.

Yes, this article does clear up some confusion. However, regardless of witness proofing, what I am most concerned (and rather confused) about is that assuming that the main reason Witness #1 retracted his statement was because of security issues, how could those working at the ICC not have foreseen this; allowing a vulnerable and traumatized witness to be seen by his accused perpetrator (and who knows who else may have been in the visitor's area)??

This article by Tracey Gurd on preparing witnesses for the trial at the ICC was enlightening and made some things clearer. I draw the same conclusion as several other journalists, getting the impression that the Prosecution should have been prepared better (there were also some other events or omissions by them which build up that impression). What you wrote here would also be a good thing for the Prosecution to tell the people - I bet most journalists, especially from the Anglo-Saxon world, don't know about the Pre-Trial decision and therefore the limitations which faces the Prosecution in this respect. Thanks. Karen Kleinwort (German freelance correspondent based in The Hague, specialising on international justice issues)
